Welcome to www.beautycarechoices.com. These Terms of Service ("Terms") form a binding agreement between you and Beauty Care Choices ("Beauty Care Choices," "we," "us," or "our") and govern your access to and use of our website, mobile services, customer-service channels, and any products or services we provide (collectively, the "Services").

Please read these Terms carefully. By accessing or using the Services, creating an account, placing an order, or otherwise interacting with us, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility and Account

The Services are intended for users who are at least sixteen (16) years of age. To place an order or use certain features, you must be at least eighteen (18) years old or the age of majority in your jurisdiction and able to form a legally binding contract. If you are between sixteen and the age of majority, you may use the Services only with the involvement of a parent or guardian.

If you create an account, you agree to: (a) provide accurate and complete information; (b) keep your account credentials confidential; (c) promptly notify us of any unauthorized use; and (d) be responsible for all activity that occurs under your account. We may suspend or terminate accounts that violate these Terms or that we reasonably believe have been used for fraud, abuse, or unlawful conduct.

3. Products, Pricing, Availability, and Orders

We try to display product descriptions, ingredients, images, and pricing accurately, but we do not warrant that product descriptions, images, or other content on the Services are complete, current, or error-free. Colors, packaging, and formulations may vary from images and from prior shipments.

All prices are stated in U.S. dollars and exclude applicable taxes, duties, and shipping unless otherwise noted. Prices and promotions are subject to change without notice. Once an order has been placed, we may decline or cancel it (in whole or in part) for any reason, including pricing or inventory errors, suspected fraud, suspected resale or diversion, restricted destinations, or violations of these Terms. If we cancel an order after payment has been authorized, we will release the authorization or issue a refund.

4. Payment, Buy-Now-Pay-Later, and Fraud Prevention

By providing payment information, you represent and warrant that you are authorized to use the payment method and you authorize us (and our payment processor) to charge that method for the total amount of your order. We may use the Address Verification System ("AVS"), card-verification values, and other fraud-prevention tools to authenticate transactions.

If you elect to pay through a buy-now-pay-later provider such as Afterpay or PayPal, your relationship with that provider is governed by that provider's own terms, and we are not responsible for the provider's services, fees, payment plans, or credit decisions. 5. Shipping and Delivery

Shipping options, transit times, and shipping fees are described on our Shipping Policy. Risk of loss for products passes to you upon delivery to the address you provide. Carrier service levels are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs, weather, or other circumstances beyond our reasonable control.

6. Returns, Refunds, and Cancellations

Eligibility, time windows, restocking fees, and refund methods are described on our Return Policy. Once your order has been processed for shipment, we may be unable to modify or cancel it. To request a change or cancellation, contact customer service as soon as possible.

7. Promotional Codes, Gift Cards, and Discounts

Unless otherwise stated: (a) promotional and gift codes are for one-time use only, one code per order, and may not be combined; (b) codes have no cash value and are not transferable; (c) codes may be revoked if obtained through fraud or in violation of these Terms; (d) free gifts, free shipping, and discounts that depend on a minimum purchase value may be reversed if a return brings the order below that threshold. Specific promotions may carry additional restrictions disclosed at the time of the offer.

8. Order Quantity Limits and Anti-Diversion

To deter unauthorized resale or diversion of professional products, online purchases are limited to no more than six (6) units of any individual item within a rolling thirty (30) day period. We may decline, cancel, or limit orders that appear to be for resale, that exceed reasonable personal-use quantities, or that we reasonably believe are intended for diversion outside the authorized retail channel.

9. Product Information; Cosmetics and Health Disclaimer

Information on ingredients used in cosmetic products appearing on our Services is not intended to be, and should not be interpreted as, advice or a recommendation concerning the use of any cosmetic product. If you have questions about your use of a cosmetic product, please review the labeling appearing on the product, contact the product manufacturer, and/or consult a physician. The Services are designed for informational purposes only and are not a substitute for compliance with the provisions of the Federal Food, Drug, and Cosmetic Act, the Fair Packaging and Labeling Act, and the regulations published under the authority of those laws.

By using the Services, you acknowledge and agree that information displayed on the Services — including information contributed by experts, bloggers, cosmetologists, or medical professionals — is intended solely for general educational purposes. Always seek the advice of a physician or other qualified health provider with any questions you may have regarding any medical condition. Beauty Care Choices does not recommend or endorse any specific tests, products, procedures, opinions, or other information that may be mentioned on the Services. Reliance on any information provided on or through the Services is solely at your own risk.

Cosmetics and personal-care products may cause allergic reactions or irritation. Test a small area of skin before broader use, discontinue use and consult a healthcare provider if irritation develops, and follow all manufacturer instructions and warnings.

10. User-Generated Content and Reviews

The Services may allow you to submit reviews, ratings, photos, comments, and other content ("User Content"). You retain ownership of your User Content, but you grant Beauty Care Choices a worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, publicly perform, and publicly display the User Content in connection with the Services, our marketing, and our business operations, in any media now known or later developed.

You represent and warrant that: (a) you own or have the necessary rights to your User Content; (b) your User Content does not violate any law or third-party right (including intellectual-property, privacy, or publicity rights); (c) your User Content is accurate and not misleading; and (d) you have not been compensated by a third party (other than Beauty Care Choices) in exchange for your review, unless that compensation is clearly and conspicuously disclosed in the review consistent with the Federal Trade Commission's Endorsement Guides.

We may, but are not obligated to, monitor, edit, or remove User Content for any reason or no reason, including content that we believe is unlawful, deceptive, off-topic, abusive, infringing, or otherwise objectionable.

11. Intellectual Property

The Services, including all text, graphics, images, logos, button icons, audio clips, video clips, data compilations, site layout, and software, are owned by or licensed to Beauty Care Choices and are protected by U.S. and international intellectual-property laws. "Beauty Care Choices," our logo, "BCC," "BeautyCareChoices.com," and our other marks are trademarks of Beauty Care Choices. Other product and brand names are the property of their respective owners and are used on the Services to identify the products we sell.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes. You may not copy, reproduce, republish, scrape, distribute, transmit, sell, license, or otherwise exploit the Services or any portion of them except as expressly permitted by these Terms.

12. Acceptable Use

You agree not to:

Use the Services for any unlawful purpose or in violation of these Terms;
Resell, redistribute, or commercially exploit the Services without our express written permission;
Use the Services on behalf of a sanctioned person or in a sanctioned jurisdiction;
Interfere with, disrupt, or attempt to gain unauthorized access to the Services, accounts, or related systems or networks;
Scrape, crawl, harvest, or use automated means to access the Services, except for publicly accessible search-engine crawlers operating in accordance with our robots.txt;
Reverse engineer, decompile, or attempt to derive source code from any part of the Services;
Submit false, misleading, fraudulent, infringing, or abusive content;
Impersonate any person or entity or misrepresent your affiliation with a person or entity;
Use the Services to transmit malware, spam, or unsolicited commercial communications;
Circumvent quantity limits, geographic restrictions, or other technical controls.

13. Mobile Messaging and Email Marketing

If you sign up for our SMS/text-message program, your participation is governed by our Mobile Messaging Terms. Message and data rates may apply; message frequency varies. You may opt out at any time by texting STOP to the program number. Email-marketing communications include an unsubscribe link in every promotional message. 14. Third-Party Sites and Services

The Services may contain links to, or interoperate with, third-party websites, applications, and services that we do not own or control. We are not responsible for the availability, content, accuracy, or practices of any third party. Your dealings with third parties are solely between you and the third party. We encourage you to read the terms and privacy policies of any third-party services you use.

15. Disclaimers

EXCEPT AS EXPRESSLY PROVIDED BY APPLICABLE LAW THAT CANNOT BE WAIVED, THE SERVICES AND ALL PRODUCTS AND INFORMATION PROVIDED THROUGH THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

MANUFACTURER WARRANTIES, WHERE OFFERED, ARE PROVIDED BY THE MANUFACTURER AND NOT BY BEAUTY CARE CHOICES. NOTHING IN THESE TERMS LIMITS ANY MANUFACTURER WARRANTY OR ANY NON-WAIVABLE WARRANTY RIGHT YOU MAY HAVE UNDER THE MAGNUSON-MOSS WARRANTY ACT OR APPLICABLE STATE LAW.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL BEAUTY CARE CHOICES, ITS AFFILIATES, OR ITS AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO BEAUTY CARE CHOICES IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

17. Indemnification

You agree to defend, indemnify, and hold harmless Beauty Care Choices and its affiliates, and its and their respective officers, directors, employees, agents, and licensors, from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any law or third-party right; or (d) your User Content. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense.

18. Governing Law and Venue

These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Except as otherwise required by applicable law, you agree that any judicial proceeding will be brought exclusively in the state or federal courts located in Shasta County, California, and you consent to the personal jurisdiction of those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

19. Informal Dispute Resolution

Before filing any claim against Beauty Care Choices, you agree to first contact us in writing at customerservice@beautycarechoices.com or by mail at the address in Section 1 and provide a brief, written description of the dispute, your contact information, and the relief you are seeking. You and Beauty Care Choices agree to attempt in good faith to resolve the dispute through informal negotiation for at least sixty (60) days after notice is received before initiating a lawsuit or other formal proceeding.

20. California Consumer Complaints

Under California Civil Code Section 1789.3, California residents are entitled to the following consumer-rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210 or (916) 445-1254.

21. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. You may stop using the Services at any time. Sections that by their nature should survive termination (including Sections 9 through 18, 20, and 22) will survive.

22. Miscellaneous

Entire Agreement. These Terms, together with our Privacy Policy and any other policies referenced in these Terms, constitute the entire agreement between you and Beauty Care Choices regarding the Services and supersede any prior agreements relating to the same subject matter.

Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.

No Waiver. Our failure to enforce any provision of these Terms is not a waiver of that provision.

Assignment. You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign or transfer these Terms freely.

Force Majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, labor disputes, supply-chain disruptions, carrier disruptions, government actions, network or utility outages, or epidemics.

Headings. Section headings are for convenience only and do not affect interpretation.

23. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top of these Terms shows the date of the most recent revision. Changes take effect when posted. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the changes.
